Regulatory Update: OSHA Hikes Penalty Amounts

The Occupational Safety and Health Administration (OSHA) has increased the amounts that it charges in civil penalties. The new amounts apply to any penalties assessed after January 15, 2022.

Why and How OSHA Increased Penalties

The Federal Civil Penalties Inflation Adjustment Act Improvement Act requires federal agencies to adjust civil monetary penalties every year by January 15 to account for inflation. Those adjustments are considered necessary so that monetary penalties can continue to deter violations.

For serious and other-than-serious violations, the maximum penalty is now $14,502 per violation. For willful or repeated violations, the maximum penalty in 2022 is $145,027 per violation.

Some states have their own Occupational Safety and Health Plans. Those states must have maximum penalties that are at least as effective as OSHA’s penalties.
